1. Avishag Arbel company issues reloadable gift cards ("Gift Cards") for its customers, which can be purchased at the chain's stores and on the chain's website online (hereinafter the physical and/or digital voucher will be referred to as: "Gift Card"), through which company products can be purchased at the chain's stores and/or on the company's website up to the amount loaded on the Gift Card.
2. The provisions of these terms and conditions shall apply to the recipient of the Gift Card and to its holder, and the holder accepts the provisions of these terms and conditions and undertakes to act in accordance with its provisions. It is clarified that these terms and conditions apply to any person holding a Gift Card.
3. The company reserves the exclusive right to discontinue the distribution of the Gift Card and/or to change its terms and/or to change the provisions of these terms and conditions from time to time and at the company's sole discretion.
4. The provisions of these terms and conditions shall apply in addition to the company's terms of use and the company's privacy policy on the company's website at - https://www.avishagarbel.co.il/conditionsofuse
5. In any case of contradiction and/or discrepancy between the provisions of these terms and conditions and any other publications, including in written and/or broadcast media, the provisions of these terms and conditions shall prevail for all intents and purposes.
6. Each Gift Card issued by the company shall have a different identification number.
7. The Gift Card can be purchased in the chain's stores using the following payment methods: credit card, or cash.
8. Without derogating from the above, it is clarified that on the website, the Gift Card can only be purchased using a credit card.
9. The Gift Card cannot be purchased using shopping vouchers and/or any other payment method, except as specified in the clauses above.
10. The Gift Card is not reloadable.
11. The Gift Card entitles the holder to the loaded amount. It is clarified that after the full amount loaded on the voucher has been used, it cannot be reloaded and is immediately cancelled. For the avoidance of doubt, a Gift Card on which the full amount has been used cannot be reused.
12. The Gift Card is not a "debit card" as defined in the Debit Cards Law, 5746-1986.
13. Partial use of the face value of the Gift Card in a particular purchase will allow for repeated use until the remaining balance on the voucher is fully utilized.
14. For the avoidance of doubt, the loading amount of a physical Gift Card (physical voucher) does not include shipping fees. Shipping fees will be calculated separately according to the company's shipping policy.
15. The Gift Card cannot be converted to cash or credited.
16. The Gift Card will be valid for 5 years from the date of purchase. The validity of the Gift Card is indicated on the back of the physical voucher, or in the email of the electronic voucher, depending on how the Gift Card was purchased.
17. The Gift Card can be used until its stated expiration date, after which the voucher holder will lose entitlement to the stated amount. It is clarified that the company will not extend the validity of the voucher after its expiration. For the avoidance of doubt, a Gift Card that is not fully or partially redeemed by its expiration date will be immediately canceled on its expiration date, and this will not grant the holder any right and/or demand and/or claim against the company or anyone on its behalf.
18. A damaged and/or counterfeit Gift Card will not be honored. A damaged Gift Card is a card whose number is faded and/or blurred and the like such that it cannot be clearly identified, as well as a broken card or one with another physical defect. In case of loss, theft, or damage, the company will not exchange it for another gift voucher and no consideration and/or compensation will be given for such a card.
19. In accordance with the provisions of Section 6(c) of the Consumer Protection (Cancellation of Transaction) Regulations, 5771-2010, a transaction paid for with a Gift Card cannot be canceled. 20. For an order made using a Gift Card, a credit voucher can only be issued for redemption on the website or in the chain's stores.
21. These terms and conditions will be available for review on the company's website, in every store of the chain, and at the company's offices.
22. The competent courts in Tel Aviv shall have exclusive jurisdiction to hear any case of dispute or disagreement regarding the provisions of these terms and conditions and/or the Gift Card.
